Your Acceptance

This is an agreement between Andium, Inc., a Delaware corporation (“Andium"), the owner and operator of www.andium.com (the “Andium Site”), and you (“you” or “You”), a user of the Service. BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE TO THESE TERMS OF SERVICE, AND ANDIUM' PRIVACY POLICY. If you choose not to agree with any of these terms, you may not use the Service.

Andium Service

These Terms of Service apply to all users of the Andium Service. Information provided by our users may contain links to third-party websites that are not owned or controlled by Andium. Andium assumes no responsibility for, and shall not be liable for, any damages, claims or other liability arising from or related to your use of any third-party website.

Andium Access

A. Andium may make available to you various payment processing methods for the purchase of products from the Andium Service. You must abide by any relevant terms and conditions or other legal agreement governing your use of a given payment processing method. You agree to pay for any products ordered.

B. To use the Andium Service, you will need a compatible device, working Internet access, and compatible software. You may need to install updates to the Andium Service from time to time to continue using the Service.

C. You agree not to use any automated system that accesses the Andium Service beyond what a human can reasonably produce. You must secure permission before testing or monitoring the Andium Service.

D. Access to certain aspects of the Andium Service may require you to provide personal information. Andium’s privacy policies explain how we treat your personal data.

E. When using the Andium Service, you may be exposed to Submissions from various sources. Andium is not responsible for the accuracy or legality of such Submissions.

Intellectual Property Rights

A. The design of the Andium Service and its related content are owned by Andium or licensed to it, and are protected under copyright and intellectual property laws.

B. Following payment for a product, you will have a non-exclusive right to download or stream that product as permitted by Andium.

User Submissions

A. Users can publish and sell applications to other users of the Andium Service. You must have the legal authority to bind any entity you represent to these Terms.

B. You are responsible for your own Submissions. Andium is not responsible for the validity or accuracy of these submissions.

C. If your product uses personal information from users, you must inform them and provide adequate privacy notice.

D. You agree not to submit material that is protected by third-party rights unless you have permission.

E. Andium does not endorse any Submission and disclaims any liability in connection with them.

Warranty Disclaimer

Your use of the Andium Service is at your own risk. Andium disclaims all warranties in connection with the Service.

Limitation of Liability

Andium shall not be liable for any direct or indirect damages resulting from any use of the Service.

Indemnity

You agree to defend, indemnify, and hold harmless Andium from any claims arising from your use of the Service or violation of these Terms.

Ability to Accept Terms of Service

You affirm that you are at least 16 years old. If you are under 16, you may not use the Andium Service.

Assignment

These Terms may not be transferred or assigned by you.

General

These Terms shall be governed by the laws of the State of Delaware. Any legal disputes shall be decided in Delaware.
